This privacy policy explains how and why we collect and use your personal data when you visit our website, sign up to receive news and updates from us, fundraise for us or make a donation.

When we refer to “we” or “us” in this privacy policy we are referring to I Choose Freedom Charity. We are we are registered with the Charity Commission for England and Wales with charity number 289508.

We are a controller of your personal data, which means we are responsible for deciding how we collect, store and use data about you. We are registered with the Information Commissioner’s Office with registration number Z6182290.

  1. When you use our Website

Our website is not intended for children and we do not knowingly collect data relating to children via our website.

When you use our website, we will collect the following types of personal data:

  • technical data such as internet protocol (IP) address and the browser you are using (e.g. Internet Explorer);
  • usage data including when you visited the website and which pages you viewed during your visit.

Our Cookies Policy has information about how we use cookies on our website.

We will only collect and use your personal data in this way if:

  • you have given your consent; or
  • it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.

  1. Subscribing to our Newsletter and Keeping in Touch

We’d like to keep in touch about the work that we do, events that we organise, ways in which you can support us.

We will only send you direct marketing communications by email if you consent, e.g. by signing up to receive our newsletter.

You can opt out of email updates by clicking the ‘unsubscribe’ link in any of our emails or you can contact us at info@ichoosefreedom.co.uk at any time to opt out, change your contact details or to update your communication preferences.

  1. Fundraising and Making a Donation

If you decide to support us by making a donation we will ask you to give us your name and address, and we’ll ask you to complete a Gift Aid declaration. You can do this by downloading and filling in a Donation Form from our website, or by clicking the ‘Donate’ button on our website and donating via the third-party fundraising platform JustGiving.

We collect and use your personal data in this way if:

  • we are under a legal obligation (e.g. a requirement to collect and keep records of Gift Aid declarations); or  
  • it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.

If you decide to arrange a fundraising event and you collect sponsorship or donations from other people, we will ask you to complete the Sponsorship and Gift Aid Declaration Form on our website. When you ask people to give you their name, address and Gift Aid information, you should make sure they understand that this information will be shared with us and you should direct them to this privacy policy.

  1. Change of purpose

We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose.

If we need to use your personal data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

Please note that we may process your personal data without your knowledge or consent where this is required or permitted by law.

  1. Sharing your personal data

We only ever use your personal data if we are satisfied that it is lawful and fair to do so. We may disclose your personal data to:

  • external companies who provide IT and system administration services to us;
  • our professional advisers – e.g. our accountants, auditors, bankers, insurers and lawyers;
  • if we are under a legal duty to disclose or share your personal data – e.g. if we are required to do so by a court order or for the purposes of prevention of fraud or other crime;
  • where we need to share your personal information with a regulator – e.g. making returns to HMRC or reports to the Charity Commission;

  1. Data Security

We constantly work to make sure that your personal data is properly protected through encryption, firewalls and monitoring. We make sure that your personal data is only seen by people who need to view it for their work and that our staff are trained in protecting your information.

We have put in place procedures to deal with any suspected personal data breach. In the event of a significant personal data breach, we will inform the regulator and, if deemed necessary, we will inform the individuals who have been impacted.

If we transfer your personal data out of the UK, we put in place safeguards to ensure it is protected.

  1. Data retention

We will only keep your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements.

We will keep a record of donations subject to Gift Aid for at least seven years to comply with HMRC rules.

We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of a legal claim connected to our relationship with you.

  1. Your rights

You have the right to:

  • Request access to your personal data (commonly known as a subject access request). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.
  • Ask us to correct personal data that we hold about you which is incorrect, incomplete or inaccurate.

In certain circumstances, you also have the right to:

  • Ask us to erase your personal data from our files and systems where there is no good reason for us continuing to hold it.
  • Object to us using your personal data to further our legitimate interests (or those of a third party) or where we are using your personal data for direct marketing purposes.
  • Ask us to restrict or suspend the use of your personal data, for example, if you want us to establish its accuracy or our reasons for using it.
  • Ask us to transfer your personal data to another person or organisation.

If you have given your consent to us processing your personal data, you have the right to withdraw your consent at any time. Once we have received notification that you have withdrawn your consent, we will no longer process your personal data and, subject to our retention policy, we will dispose of your data securely.
